1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you or your company ("you," "Partner") and CXDeploy Inc. ("we," "us," "our") concerning your access to and use of the CXDeploy software-as-a-service platform (the "Service") as part of our Early Access Program (the "Program").
2. The Early Access Program
The Program is a collaborative, pre-commercial engagement.
Our Obligation
We will provide you with access to the Service, including its "Promote & Deploy" features, at no charge for a period of six (6) months from your acceptance of these Terms. We will provide reasonable technical support.
Your Obligation
You agree to provide timely, candid feedback on the Service, including participating in periodic feedback calls (e.g., bi-weekly).
3. Your Account and Responsibilities
You are responsible for all activities that occur under your account. You are responsible for securely creating and managing the Genesys Cloud OAuth credentials (Client ID and Client Secret) you provide to the Service, which must have the necessary read and write permissions for the Service to function.
4. Service Data
You retain all ownership rights to your configuration data ("Service Data"). You grant us a limited, non-exclusive, worldwide, royalty-free license to use, copy, store, modify, and display your Service data solely for the purpose of operating, providing, and improving the Service (including the execution of promotions you authorize). We will not use your Service Data for any other purpose without your explicit consent.
5. Confidentiality
Both parties agree that all non-public information exchanged during this Program (including your feedback, your Service Data, and our product roadmap) is confidential and shall not be disclosed to any third party.
6. AS-IS; Limitation of Liability
The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. You agree that your use of the Service is at your sole risk. The Service is designed to make changes to your Genesys Cloud environment. You are solely responsible for validating all operations and their impact, and you assume all risks associated with promoting, updating, or deleting configurations.
To the fullest extent permitted by law, we disclaim all warranties, express or implied. In no event will we or our directors or employees be liable to you or any third party for any direct, indirect, consequential, or punitive damages (including lost profits, lost revenue, or data loss) arising from your use of the Service, even if we have been advised of the possibility of such damages.
